The Council consists of a Commissioner, and two to four other members, all appointed for a finite term, by the Minister for Health and Ageing. Council appoints a Chief Executive Officer and employs the number of staff it considers necessary to assist in the performance of its functions and the exercise of its powers. The Council is independent of registered organisations. The Minister has appointed a five member Council. For the purposes of the Commonwealth Authorities and Companies Act, the Commissioner and members of Council are non-executive directors and hold office on a part-time basis. No members have other material relationships or associations with PHIAC and therefore are independent of PHIAC and management. In addition to the functions of the Council outlined in section 264-10 of the Act, section 264-20 outlines the power of the Council to do all things necessary in connection with the performance of its functions. Section 267-10 notes the Commissioner’s responsibility for convening Board meetings. Council members may seek independent external professional advice, at PHIAC's expense, when required in the performance of their duties. The remuneration of the Commissioner and Council members is determined by the Remuneration Tribunal. |
