RULE NO. 3
PRIVATE HEALTH INSURANCE ADMINISTRATION COUNCIL NATIONAL HEALTH ACT 1953 RULES MADE UNDER SUB-SECTION 82G(r)

I, SANDRA HALLEY, Commissioner, Private Health Insurance Administration Council ("the Council"), in pursuance of the powers vested in me under sub-section 82C(2) of the National Health Act 1953 ("the Act"), and, in accordance with sub-section 82G(r) of the Act, hereby revoke Council Rule No.2 made on the 22 October 1990, and in lieu thereof, hereby determine that the following rules shall apply for the purpose of the performance of the functions of the Council and the exercise of its powers.

  1. In order to assist in the control and monitoring of the Reinsurance arrangements under the Act, statistics relating to individual registered organisations will be made available to registered health insurance organisations under sub-section 82G(a) and sub-section 82G(t), following requests in writing from those organisations, and shall include all data shown in the form PHIAC 1, which is lodged quarterly with the Council by all organisations, excluding items as indicated below:-

    1. data showing the break-up of membership and coverage between front-end and non front-end deductibles for both basic and supplementary tables,

    2. ancillary table membership and coverage,

    3. data showing front-end and non front-end deductible days and benefits for basic table ordinary account,

    4. details of individual supplementary and ancillary tables as shown on page 9 of form PHIAC 1,

    5. ancillary benefits by type of ancillary (page 10 of PHIAC 1)

  2. In order to make information publicly available, statistics and other benefit information from PHIAC 1 returns relating to registered organisations will be made available, in aggregate form so as to not identify individual organisations, under sub-section 82G (m) in accordance with the charges determined by Council.

The above rule shall apply from the date of signing of this instrument and shall remain in force until otherwise revoked or varied by a further instrument.
