INSURERS TO NOTIFY PHIAC OF OFFICER AND CEO

In the Private Health Insurance Act 2007 the title of ‘Public Officer’ has been removed. The Act requires that returns lodged to PHIAC must include a declaration signed by an officer of the insurer that the information in the return is true and correct. An officer is defined in the Act as:

  • a director of the insurer; or
  • a chief executive officer of the insurer; or
  • a person who makes, or participates in making, decisions that affect the whole, or a substantial part, of the business of the insurer.

The Act requires, under conditions of registration, that private health insurers provide PHIAC with details of directors, officers, auditor and appointed actuary. To ensure PHIAC has current contact details please use the form (Officer and Director listing) on PHIAC’s web site to provide details of these persons to PHIAC.

It is a requirement under section 169-15 of the Act that private health insurers notify PHIAC of changes of chief executive officer not more than 28 days after the change takes effect. Please inform PHIAC of any change to the CEO details, including temporary changes, using the form (Notification of change of Chief Executive Officer) on PHIAC’s web site.

Also please inform PHIAC of any change in other officers, including directors, using the form (Notification of change of Officer or Director) on PHIAC’s web site.

PHIAC will communicate with the CEO and officer on matters relating to the private health insurer. Insurers may also wish to identify a person or persons, other than the CEO and officer, to whom PHIAC should send statistical reports, or with whom PHIAC should liaise in regard to the preparation of returns to PHIAC. Insurers are invited to provide details of these persons, identifying their area of involvement (e.g. PHIAC1 reporting)
