 Clarification of Advice to insurers on PHIAC 1 requirements when Lifetime Health Cover status changes.

 
The Private Health Insurance Act 2007 includes a provision in section 34-10 requiring health insurers to remove the Lifetime Health Cover (LHC) loading on adults with hospital cover after ten years of continuous hospital cover subject to a loading.
 
PHIAC Circular 10/04 informed insurers of the reporting requirements for the quarterly PHIAC 1 Form in regard to the removal of LHC loading. Circular 10/04 provided an example of a person that has ceased their private health insurance having had more than 10 years coverage and again takes out cover at a later date.
 
The Department of Health and Ageing issued Circular 13/10 on 22 March 2010 – this circular supercedes Circular 54/09 of 18 August 2009 which was referenced in PHIAC Circular 10/04 and in examples therein.
 
Insurers, when considering the requirements of Circular 10/04, should have regard to the Department of Health and Ageing Circular 13/10 which clarifies treatment of Lifetime Health Cover loadings.
