Rules made by PHIAC

The Private Health Insurance Rules 2007 (the Rules) are made by the Private Health Insurance Administration Council (the Council) under item 1-3 of the table in section 333-25, of the Private Health Insurance Act 2007 (the Act).

Private Health Insurance (Health Benefits Fund Administration) Rules 2007

As amended

made under section 333-25 of the Private Health Insurance Act 2007

This compilation was prepared on 15 November 2008 taking into account amendments up to Private Health Insurance (Health Benefits Fund Administration) Amendment Rules 2008 (No. 2)

The Rules amend the Health Insurance (Health Benefits Fund Administration) Rules 2007 to extend the period of operation of rule 12A. Rule 12A specifies simplified arrangements for private health insurers which are incorporated associations but intend to change their status to a corporation under the Corporations Act 2001 to apply under section 146-5 of the Act to transfer their health insurance business to the new corporation by operation of an order under a law of a State or Territory. All private health insurers must be Corporations Act companies by 1 January 2010.

Private Health Insurance (Insurer Obligations) Rules 2009

Made under item 2 of the table in section 333 -25 of the Private Health Insurance Act 2007

These Rules repeal the Private Health Insurance (Insurer Obligations) Rules 2007 and establish prudential standards for private health insurers that set minimum requirements for the governance arrangements of private health insurers, specify appointed actuary requirements of private health insurers and detail reporting and notification requirements for private health insurers.

As amended

This compilation was prepared on 9 January 2008 taking into account amendments up to Private Health Insurance (Risk Equalisation Administration) Amendment Rules 2007 (No. 1)

These Rules are made for the purposes of Part 6-7 of the Private Health Insurance Act 2007.

The Rules are made under section 333- 25 of the Private Health Insurance Act 2007

The Rules amend the The Private Health Insurance (Insurer Obligation) Rules 2009 to include a new disclosure standard. The increased disclosure requirements for private health insurers will come into effect on 1 January 2011. The additional information provided to Council will facilitate ongoing risk assessment of insurers and early detection of prudential risk.

Private Health Insurance (Insurer Obligations) Amendment Rules 2011 (No. 1)

As Amended

The Rules are established under section 163-1 of the Private Health Insurance Act 2007 and are made by the Private Health Insurance Administration Council under item 2 of the table in section 333-25 of the Act.

The Rules amend the Private Health Insurance (Insurer Obligations) Rules 2009 to update the Appointed Actuaries Standard.

The Rules have been prepared by the Office of Legislative Drafting and Publishing, Attorney General’s Department, Canberra. An updated Compilation is available here.
